The kratons.com website, including any of its subdomains (collectively referred to as the ‘Website’ or ‘Portal’) is operated by Kratons Travel S.L. (‘KRATONS’), con NIF B72875909, registered in the Registry of Tourism Companies of the General Department of Tourism of the Community of Madrid as holder of the CICMA number 4212. KRATONS takes personal privacy very seriously, including privacy of all individuals visiting our Website (hereinafter referred to as the “Website”) or anyone sharing information through the Website or other interaction channels available in our Website (hereinafter referred to as “you” or the “user” or in plural, the “users”).

KRATONS is committed to processing your data in accordance with applicable data protection legislation. In particular, KRATONS will meet the principles of Organic Law 3/2018, of 5 December, on Personal Data Protection and Securing Digital Rights, as well as those under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and any other implementing regulations in force at any given time. 

This privacy policy applies exclusively to data collected through communication channels on the Website (including, but not limited to, contact email and phone number available therein). We therefore urge all users to carefully read this privacy policy in order to learn about how any of their data collected through the communication channels on the Website will be processed.

As a consequence, KRATONS issues this privacy policy so the Website’s users may be aware of how their data will be processed.

– recruitment information including your C.V. and your employment history.

Whilst you are not required to provide any personal information to access the public areas of our Website, please note that we also obtain information through the use of cookies and from your IP address.

5. ‐What are the purposes of processing your data?

KRATONS collects and processes your personal data using emails sent and/or calls received in order to meet and manage any requests, questions, and/or enquiries sent by you. In short, to serve you as requested.

Furthermore, any time you send your CV or professional information to the specifically dedicated email address on the Website (info@kratons.com), we will process your data in order to manage any CV’s and information sent by candidates for current and/or future recruitment processes.

6. ‐What are the legitimate grounds for processing your data?

A precontractual and/or contractual relationship, if appropriate, plus the legitimate interest of KRATONS  are the legal bases for meeting and managing any requests, questions, and/or enquiries sent. With regard to personal data processing when managing your application for KRATONS  recruitment processes, the legal basis is you granting your consent by sending us your CV and personal information to the dedicated email address. In other words, the act of sending us said information represents a clear affirmative action for processing your personal data and considering you as a potential candidate.

7. ‐How long do we store your data?

KRATONS will process your personal data for as long as needed to meet the purposes set out in this Privacy Policy, and this also includes storing your personal information to comply with the provisions of relevant legislation, especially with regard to limitation periods laid down in law, and for establishing, exercising or defending legal claims.

Our criteria for this is determined by: (a) the purpose of the data collected and meeting said purpose; (b) the reasons why the data is collected: i.e., if consent is provided, you can withdraw it at any time, and (c) mandatory storage periods under contractual and regulatory requirements.

Keep in mind that there are some situations where KRATONS may store your data for the time required to establish, exercise, or defend legal claims, requirements, responsibilities, and legal, contractual or ethical obligations, and your data will always be properly blocked.

If your personal information relates to an unsuccessful job application with us, we might use such personal information to contact you where positions or opportunities emerge that we believe you might be suitable for.

In addition, to respond to an enquiry you have sent via our Website or otherwise we may sometimes share your information with our third party service providers who perform functions on our behalf. – our professional advisers (i.e. auditors, accountants and/or lawyers);

– suppliers who provide certain tourism-related services (i.e. hotels) or support services (i.e. drafting of agreements and recruitment management tools);

– IT service providers to KRATONS, such as those who administer and maintain our Website for us;

– third parties who verify recruitment information provided by applicants. 

Therefore, depending on the purposes why your personal data is being collected, any of the following people may access them individually: (a) our service providers as necessary to rendering the services; (b) regulatory authorities and other third parties in compliance with applicable legislation; (c) third parties/data processors (service providers processing information as data processors under the instructions of KRATONS). All of this will only take place after undertaking the actions necessary to ensure that we may share said information and after entering into the relevant external data processor contract, where applicable, in compliance with data protection regulations.

7. ‐What are your rights when you provide us with your data?

Users may request the following rights:

– Right to request access to personal data: you may ask KRATONS if it is processing your data, and if so, access them.

– Right to request rectification if there are any data inaccuracies or fill in any incomplete data we have.

– Right to request data erasure.

– Right to request restriction of processing: in this event we would only store them for exercising or defending legal claims.

– Right to object to processing: KRATONS will stop processing personal data, except when necessary for legitimate reasons or for exercising or defending possible legal claims.

– Right to data portability: should a user wish to have their data processed by a different controller, KRATONS will transmit their data to the new controller.

– Right to not be subject to a decision based solely on automated processing.

If you granted your consent for a specific purpose you may withdraw it at any time. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

Please note that you have the right to lodge a complaint with the supervisory authority (Spanish Data Protection Agency) and with other public competent bodies for any complaints regarding your personal data. 

8. ‐How do we protect your personal data?

In order to protect the information you input to our Website from unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction or accidental loss, we have put in place appropriate technical, physical and managerial procedures to guarantee the appropriate level of security in accordance with the applicable regulations.  

Despite these measures being implemented efficiently, users are cautioned that Internet security measures are not impenetrable. KRATONS is not liable for the acts of third parties who gain access to said data and information by violating these measures.

KRATONS’ professionals involved in the provision of services to the user are committed to not disclosing or using any information they have accessed. Any information provided by the user will be confidential at all times, and will not be used for any purposes outside of those related to managing the requests and services they ask from KRATONS, if appropriate. In this sense, we are committed to not disclosing or revealing information about the user’s intentions or the reasons behind the information requested.

This Website may contain links to other websites. Please be aware that we are not responsible for the privacy and data processing employed by other websites. This privacy policy applies solely to the information collected on our Website. We recommend reading the privacy and data processing policies of the websites linked on our Website or of the ones you visit anyways.

10. ‐Amendments to our privacy policy

We will only use your personal data as set forth in the privacy policy existing at the time your personal data was collected. KRATONS reserves the right to amend this privacy policy at any time. We will post these changes on our Website, so we recommend you check our privacy policy every time you visit it. If at any time we decide to use your personal data in a way different from that stated at the time it was collected, we will notify you via email (provided that you have provided us your email address). At that time, you will be given the option to allow that the personal data you provided us before our privacy policy was amended be used and disclosed in other manners.

If any of this privacy policy’s clauses is held to be invalid or unenforceable, the remaining terms and conditions will remain in effect, and they shall continue to be valid and enforceable pursuant to current implementing regulations.

Special category of personal data: We will not collect or process any particularly sensitive data or data included in the special category for users’ personal data, unless they have specifically provided us with them.

Automated decision-making: We will not use automated decision-making, which includes profiling, unless we have been specifically authorized to do so. In that case, we would let you know about the logic used in the decision, and about the meaning and expected consequences of said processing for you.

Updating data: It is crucial that the personal data we have from you be up-to-date and accurate. Therefore, we ask you to inform us of any changes in your personal data as soon as possible. This way KRATONS’ information is always up-to-date and accurate.
